The hearing scheduled for January 11, 2016 is the first step in a multi-step process in determining whether the area should be designated as an area in need of redevelopment. In the event that at the conclusion of the process some or all of the area is determined by the governing body to be an area in need of redevelopment, such a determination may have an impact on the ownership of property so designated. In particular, a determination that property is designated as an area in need of redevelopment would operate as a finding of public purpose and would allow the City of Newark to acquire the property in the area by condemnation (against the owner’s will) for redevelopment purposes.
The Central Planning Board was directed by the Municipal Council, pursuant to Resolution 7R3-B(s) (adopted January 13, 2015, to conduct a preliminary investigation in order to investigate the area listed within the chart below and generally described as the West Ward Area 1 Study Area (the “Study Area”) to determine if the Study Area should be determined to be an area in need of redevelopment under the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1, et seq.
